General Terms and Conditions

1. General provisions

1.1 Scope and acceptance of the GTC

These General Terms and Conditions (hereinafter: GTC) set out the general contractual terms for using and purchasing from the HologenX.hu online store (hereinafter: Online Store) operated by HologenX s.r.o. (hereinafter: Service Provider).

Purchasing in the Online Store is possible by placing an order electronically, in the manner set out in these GTC. Anyone may use the services of the Online Store provided that they acknowledge and accept the provisions of these GTC as binding.

The scope of the GTC covers all legal relationships created through the Online Store, as well as all contracts concluded between the Service Provider and Users, regardless of whether the service is used from Hungary or from abroad.

1.3 Customer service and complaint handling

The Service Provider’s customer service can be reached via the Online Store interface and at the email address provided above. Customer service is responsible for informing Users, handling complaints, and facilitating the resolution of potential disputes.

Users may submit complaints related to the Online Store or the Service Provider’s activities to the Service Provider by email or by post. The Service Provider investigates the complaint without delay, but no later than within 30 days from receipt, and informs the User of the outcome in writing.

In the event of a consumer dispute, the User may also use the European Union’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

1.4 Language of the contract

The language of contracts concluded in the Online Store is Hungarian. The Service Provider is not responsible for the accuracy or completeness of foreign-language versions of the Online Store. In the event of any discrepancy, the Hungarian version shall prevail.

2. Use of the online store

2.1 Browsing and purchasing

The services of the Online Store are available without registration. Users may freely browse the Online Store’s selection and provide the necessary data during the ordering process without having to register.

The advantages of registration include a faster ordering process, tracking previous orders, and personalised offers. However, the Service Provider also respects the decision of Users who do not wish to register.

Purchasing in the Online Store is not tied to registration; purchases are possible without registration.

2.2 Registration and login

Users may register in order to use the Online Store’s services. During registration, Users must provide true and accurate data and accept these GTC and the Privacy Notice. The Service Provider reserves the right to refuse or revoke registration at any time without providing reasons.

After registration, the User may log in to the Online Store and access their account and the services of the Online Store. The User is responsible for keeping their account password secure and for all activities carried out through their account.

2.3 Ordering process

By selecting products in the Online Store and clicking the “Add to cart” button, the User can place selected products into their virtual cart. The User may view the contents of the cart at any time, change quantities, or remove products.

To finalise the order, the User must provide shipping and billing details and select the desired payment and delivery method. During the ordering process, the User may register, but this is not mandatory. Before submitting the order, the User has the opportunity to review and modify the order details.

By submitting the order, the User makes an offer to purchase the selected products and acknowledges that the order entails a payment obligation. The Service Provider confirms receipt of the order by email within 48 hours at the latest, which constitutes the conclusion of the contract between the Service Provider and the User.

If an ordered product is not available, the Service Provider informs the User without delay and offers the option to modify the order or refund the amount already paid. The Service Provider is not liable for inconveniences arising from potential errors in stock data.

2.4 Prices and payment methods

Prices displayed in the Online Store are in Hungarian forints (HUF) and include value added tax (VAT). Prices do not include shipping costs, which the User can review during the ordering process.

The Online Store offers the following payment methods:

  • Electronic instant payment (Barion)

Online card payments and other payment methods are processed through the Barion system. Bank card and other payment-related data are not transferred to the merchant. The service provider Barion Payment Zrt. is supervised by the Hungarian National Bank; its licence number is H-EN-I-1064/2013.

The Service Provider issues an electronic invoice for each purchase and sends it to the User by email after order confirmation. The invoice includes the price of the ordered products, shipping costs, and any other applicable fees.

2.5 Shipping information

The Service Provider delivers the ordered products to the shipping address provided by the User or to the selected parcel locker. The delivery time is typically 3–4 business days, but may vary depending on product availability and the selected delivery method.

The Service Provider offers the following delivery methods:

  • Courier delivery to your address (on business days between 8:00 and 17:00)
  • Parcel locker (24/7 access)

Shipping fees may vary depending on the order value and the selected delivery method. The User can review the exact shipping fees during the ordering process.

2.6 Right of withdrawal and refund

Pursuant to Government Decree 45/2014 (II. 26.), the User has the right to withdraw from the purchase without giving any reason within 14 days from receiving the product. To exercise the right of withdrawal, the User must send a clear statement to the Service Provider (e.g., by post or email) informing the Service Provider of the intention to withdraw.

In the event of withdrawal, the User must return the product to the Service Provider without undue delay, but no later than 14 days from communicating the withdrawal. The costs of return are borne by the User. The Service Provider refunds the price of the returned product no later than 14 days from becoming aware of the withdrawal, using the same payment method as the original transaction.

2.7 Special provisions for dietary supplements

Dietary supplements are special products subject to different rules due to hygiene and public health requirements. The User may exercise the right of withdrawal only for dietary supplements in unopened, undamaged packaging.

If the User has already opened the packaging of the dietary supplement, the Service Provider is not obliged to accept the returned product and is not obliged to refund the product price. Exceptions include cases where the product is defective or damaged and the User indicates this to the Service Provider upon receipt.

The Service Provider recommends that Users act prudently when purchasing dietary supplements and open the packaging only if they are sure they wish to keep the product.

If the User has any questions or concerns regarding the return of dietary supplements, the Service Provider’s customer service is happy to assist.

3 Intellectual property rights

The Online Store and its entire content (including texts, images, graphics, logos, icons, software and other elements) are the property of the Service Provider and are protected by copyright. Copying, modifying, distributing, transmitting, making available to the public, or otherwise using any part of the Online Store is permitted only with the Service Provider’s prior written consent.

The User acknowledges that by using the Online Store they access content that constitutes the Service Provider’s intellectual property. The User undertakes to use the Online Store’s content solely for personal, non-commercial purposes and not to engage in any activity that infringes the Service Provider’s intellectual property rights.

3.2 Trademarks

The trademarks, logos and other marks displayed in the Online Store are the property of the Service Provider or its partners. Their use, reproduction, or distribution is strictly prohibited without the owner’s prior written permission.

The User acknowledges that unauthorised use of trademarks constitutes an infringement of trademark rights and may result in legal consequences. Limitation of liability

4 Limitation of liability

5.1 The Service Provider’s liability

The Service Provider makes every reasonable effort to ensure the continuous and error-free operation of the Online Store; however, it assumes no liability for operational interruptions, technical errors, or the unavailability of the Online Store.

The Service Provider excludes liability for any direct, indirect, incidental, or consequential damages arising from the use of the Online Store or from products sold through it, including lost profits, data loss, or damage to reputation.

The User acknowledges that errors may occur when using the Online Store and that the content of the Online Store may not always be up to date or complete. The Service Provider reserves the right to modify or remove any part of the Online Store’s content without prior notice.

5.2 Force Majeure

The Service Provider is not liable for failure to perform its contractual obligations if performance is prevented or delayed by force majeure events. Force majeure includes any event beyond the Service Provider’s control that the Service Provider cannot prevent even with reasonable efforts (e.g., natural disasters, acts of war, strikes, etc.).

In the event of force majeure, the Service Provider must inform the User without delay and take all reasonable measures to prevent or mitigate the consequences of the force majeure event.

6. Other provisions

6.1 Amendment of the contract

The Service Provider reserves the right to amend these GTC at any time unilaterally. The Service Provider informs Users of amendments via the Online Store interface or by email. Amendments take effect from the time of publication, and by continuing to use the Online Store the User accepts the amended GTC.

If the User does not accept the amended GTC, they are entitled to terminate the contract and close their account.

6.2 Governing law and dispute resolution

These GTC and contracts concluded through the Online Store are governed by Hungarian law, without regard to conflict-of-laws rules.

In the event of any dispute related to the use of the Online Store or the contract, the parties will strive to resolve the dispute amicably through negotiations. If this fails, the parties may turn to the competent Hungarian courts.

6.3 Validity of the GTC

If any provision of these GTC proves to be invalid, unlawful, or unenforceable, this does not affect the validity and enforceability of the remaining provisions of the GTC.

The parties must replace the invalid, unlawful, or unenforceable provision with a provision that best reflects the intent and economic purpose of the original provision.

7 Appendices

7.1 Sample withdrawal/termination statement

7.2 Complaint handling information

The Service Provider aims to fulfil all orders with appropriate quality and to the full satisfaction of the User. If the User nevertheless has a complaint regarding the contract or its performance, the User may submit the complaint using the contact details provided above.

The Service Provider examines oral complaints immediately and remedies them as necessary. If the User does not agree with the handling of the complaint, or if immediate investigation is not possible, the Service Provider records the complaint and its position in minutes without delay and, in the case of an oral complaint communicated in person, hands a copy to the User on the spot.

The Service Provider responds to written complaints in writing within 30 days. If the complaint is rejected, the Service Provider provides reasons. The Service Provider keeps the minutes of the complaint and a copy of the response for five years and presents them to supervisory authorities upon request.

If the nature of the User’s complaint requires it, the Service Provider cooperates during the complaint handling process with the competent consumer protection authorities, conciliation bodies, and other organisations.

If the complaint is rejected, the Service Provider informs the User in writing which authority or conciliation body the User may initiate proceedings with. The information also includes the seat and website of the competent authority and/or the conciliation body competent for the User’s place of residence or stay, as well as their postal address.
